Bankruptcy hearings are processed in bankruptcy courts, which are federal courts. We begin by locating the federal district where the person in question resides. Since late 1990s, the U.S. court system started making available case filings through Public Access to Court Electronic Record (PACER). Rondout Legal Services can obtain copies of files that are archived. To receive pleadings or find information on a bankruptcy case, one needs to find the bankruptcy case and its corresponding court docket. Bankruptcy case information may not be available if it was used as evidence in a criminal trial.
Chapter 7 Bankruptcy and Chapter 13 Bankruptcy Records
Bankruptcy public records are deleted based on the filing date. The discharge date has no effect on when the bankruptcy or accounts included in the bankruptcy are deleted. Both should indicate they are discharged once the bankruptcy has been completed
Chapter 7 bankruptcy is deleted 10 years from the filing date because there is no repayment of any of the debt. Chapter 13 bankruptcy is deleted seven years from the filing date because a portion of the debt is repaid under the discharge plan. Accounts included in the bankruptcy will have their status updated to show that they are included in the bankruptcy.
